The European Commission has decided to withdraw proposed regulations concerning technology patents, artificial intelligence (AI), and consumer privacy on messaging apps. This development comes as the Commission determined that it could not secure approval from EU lawmakers and nations for these measures. The scrapped regulations included a proposal designed to manage standard essential patents (SEPs), crucial for telecom equipment and smart devices. This rule aimed to mitigate expensive and extensive legal disputes but faced opposition from major players like Nokia, Ericsson, and Siemens. Despite backing from companies reliant on SEPs, such as Apple and Google, the Commission saw no viable agreement emerging in the near future.
IndexBox data indicates that the EU’s technology sector has exhibited robust growth, with a compound annual growth rate (CAGR) of 5.8% in the past decade. This highlights the increasing importance of a stable and fair regulatory framework to support continued expansion.
Additionally, the AI Liability Directive, allowing consumers to claim compensation for damages caused by AI, was withdrawn. The Commission still plans to potentially introduce a revised proposal in the future. Legal experts emphasize that this should not be interpreted as a shift in the EU’s broader regulatory stance on AI innovations.
Moreover, an outdated eprivacy regulation, targeting messaging services like WhatsApp and Skype, was also abandoned. This rule aimed to align these platforms with telecom operators concerning user privacy, but it was hampered by disagreements over online tracking cookies and measures to manage child pornography.
